عقد الشراكة بين القطاع العام والقطاع الخاص

Abstract

يعد عقد الشراكة بين القطاع العام والقطاع الخاص من العقود الإدارية التي ظهرت نتيجة تطوير الأساليب التقليدية في إدارة المرفق العمومي و يرتكز هذا النوع من العقود على المشاريع الأساسية الخاصة بتطوير البنى التحتية لدولة ،هذا ما يحقق تقديم أفضل الخدمات للمواطنين من حيث الكم و النوع و السعر التنافسي أيضا، ويتخذ عقد الشراكة عدة أشكال من أهمها: عقد البوت و عقد الامتياز، ويتم إبرامها وفق إجراءات و طرق محددة مسبقا من طرف الشريك العام.
