الحماية الجزائية للغابات في التشريع الجزائري

Abstract

تهدف هذه الدراسة إلى تبيان الأحكام الموضوعية الخاصة بالحماية الجزائية للغابات، حيث نص المشرع الجنائي الجزائري من خلال القانون 23_21 عن الجرائم الخطيرة الواقعة على الأملاك الغابية، خاصة جرائم حرق الغابات التي استفحلت في هذه السنوات الأخيرة، وأدّت إلى كوارث جمّة وخسائر هائلة، وكذا جرائم التعدي على الأراضي ونهب الثروات النباتية الحيوانية، كما تهدف هذه الدراسة أيضا إلى تسليط الضوء على الأحكام الإجرائية الخاصة بالحماية الجزائية للغابات، والتي أقرها المشرع الجنائي الجزائري من أجل متابعة مرتكبي هذه الجرائم، وتسليط أشد العقوبات عليهم، من خلال تبيان الأجهزة القانونية المناط بها متابعة هؤلاء المجرمين، واستحداث جهاز شرطة الغابات للبحث والتحري عن هذه الجرائم.

This study aims to elucidate the substantive provisions related to the penal protection of forests, as the Algerian criminal legislator has stipulated through Law 23_21 severe penalties for serious crimes committed against forest property. This includes particularly the crimes of forest fires, which have become rampant in recent years, leading to numerous disasters and enormous losses, as well as crimes related to encroachment on lands and looting of plant and animal wealth. Additionally, this study seeks to highlight the procedural provisions for the penal protection of forests, established by the Algerian criminal legislator to prosecute perpetrators of these crimes and impose the harshest penalties on them. This is done by identifying the legal bodies responsible for prosecuting these criminals and establishing a Forest Police unit to investigate and apprehend them.

Cette étude vise à clarifier les dispositions matérielles relatives à la protection pénale des forêts en droit algérien. Le législateur pénal algérien, à travers la loi n°23_21, a incriminé les infractions graves contre les propriétés forestières, notamment les incendies de forêts qui ont proliféré ces dernières années, causant d'immenses catastrophes et des pertes énormes. De plus, l'étude met en lumière les dispositions procédurales de la protection pénale des forêts, que le législateur pénal algérien a édictées pour poursuivre les auteurs de ces infractions et leur infliger les peines les plus sévères. Cela se fait en identifiant les organes juridiques chargés de poursuivre ces criminels et en créant une unité de police forestière pour enquêter et les appréhender.
