Abstract

تناقش هذه الدراسة التعليق على الحكم القضائي رقم 449 لسنة 2021 الصادر عن المحكمة الإدارية العليا الأردنيَّة، وقسمت الدراسة على مبحثين هما: الإطار الموضوعي في المبحث الأول والإطار الذاتي في المبحث الثاني، واستعملت الدراسة منهج التحليل اللغوي البنيوي لنصوص القانون محل النقاش، وتوصلت الدراسة إلى هشاشة القرار تأويلا، ومخالفته لصحيح القانون، وعدم الرد على الدفوع والاعتراضات بشكل وافٍ، وعليه أوصت الدراسة بالتنصيص على الرد على الدفوع ، واستعمال طرق الطعن غير العادية في الدعاوي الإدارية، مما يجعل من عدم ادراج هذه النصوص اغفالًا تشريعيًّا معيبًا بعدم الدستورية، وعدم المعقولية. This study discusses the commentary on Judicial Ruling No. 449 of 2021 of the Jordanian Supreme Administrative Court. The study is divided into two researchers: The substantive framework of the first examination and the subjective framework of the second examination. The study used the methodology of structural linguistic analysis of the texts of the law under discussion. The study found the fragility of the decision to be interpreted, its violation of the law, and the failure to respond adequately to defences and objections and the study therefore recommended that the response to the arguments be provided, and that unusual recourse methods be used in administrative proceedings Non-inclusion of these texts makes a legislative omission flawed by unconstitutionality, unreasonableness.
