Abstract

كرست معاهدة فينا لقانون المعاهدات لسنتي 1969 و 1986 الحق لأطراف المعاهدة إبداء التحفظ بشرط خلو المعاهدة من أي حظر و أن يتماشى التحفظ مع موضوع و هدف المعاهدة في مقابل ذلك لا يهم موافقة جميع الاطراف على التحفظ إذ يكفي قبول طرف واحد فقط و بالتالي فإن هذا النظام يجعل الانضمام الى المعاهدات أكثر مرونة قياسا بما كان معمول به سابقا و الذي أقرته عصبة الامم سابقا. في مقابل كل هذا و حرصا على سلامة المعاهدة و خشية تصدعها و تشتتها و حفاظا على وحدتها فقد أقرت ذات النصوص إستثناءات على هذه القاعدة نذكر منها على سبيل المثال التحفظ الذي يتعارض مع موضوع الاتفاقية وغرضها والذي يتطلب قبول كافة الأطراف لكي يكون مشروعا وبالتالي يحدث أثره أيضا التحفظ على المعاهدات المنشئة للمنظمات الدولية والذي يتطلب قبول الجهاز المختص في المنظمة. . Abstract : The Vienna Convention on the Law of Treaties of 1969 and 1986, enshrined the right for parties to the treaty to express reservations, provided that the treaty does not include any prohibition in this regard and that the reservations are consistent with the object and purpose of the treaty. On the other hand, it is not necessary that all parties accept the expressed reservations; it is enough for only one party to accept it, which makes adherence to treaties more flexible, compared to previous practice under the reign of the League of Nations. Furthermore, and out of concern for the integrity of the treaties, and in order to prevent their disintegration or cracking, and to preserve their unity, the same texts have provided exceptions to this rule, such as the acceptance of expressed reservations, opposing the object and purpose of the treaty in question, by all its parties so that these reservations are deemed legal and, therefore, produce their effects.
