Abstract: Various environmental legislations, whether local or international, have formulated a set of principles that seek to protect the environment within the framework of sustainable development, as some consider them new foundations for liability for environmental damage, but another side believes that these principles are nothing more than new terms for old contents known to civil liability in its traditional form, and the most confusing principles are the prevention principle and the precautionary principle. To achieve the objectives of this study, we followed the analytical approach to shed light on these two principles to resolve the ambiguity that surrounds them.
