دور التدابير الوقائية في تجسيد مبدأ المنافسة في مجال إبرام الصفقات العمومية

Abstract

تعتبر التدابير الوقائية في تجسيد المنافسة الحرة في مجال الصفقات العمومية من أهم المبادئ التي حرصت عليها النظم القانونية على تكريسها بالجزائر. أولى المشرع الجزائري اهتماما بالغ لفكرة تكريس حرية المنافسة في مجال الصفقات العمومية وذلك من خلال التنظيمات القانونية أهمها تنظيم الصفقات العمومية ،قانون المنافسة،وقانون الوقاية من الفساد ومكافحته وقانون العقوبات.وأخر ما توصل إليه المشرع قانون 23-12 المتضمن تنظيم الصفقات العمومية الذي حقق بإقراره لمبادئ حرية المنافسة الشفافة و المساوات تجسد ذلك من خلال الإجراءات والكيفيات التي تم اعتمادها لإبرام الصفقات العمومية بداية من إعداد دفاتر الشروط و الإعلان عن الرغبة في التعاقد الى غاية إجراء اعتماد الصفقة و المصادقة عليها وذلك من خلال ضمانات وأليات الرقابة الإدارية والقضائية المطبقة على الصفقات العموميةإلا ان الواقع العملي أثبت قصورا في فعالية هذه الإجراءات وعدم كفايتها للحد من التجاوزات أثناء إبرام الصفقات العمومية

Preventive measures in embodying free competition in the field of public procurement are among the most important principles that legal systems in Algeria have sought to establish. The Algerian legislator has paid great attention to the concept of consolidating free competition in the field of public procurement through legal regulations, the most important of which are the Public Procurement Regulation, the Competition Law, the Law on the Prevention and Fight against Corruption, and the Penal Code. The latest legislative development is Law 23-12 on the organization of public procurement, which established the principles of transparent free competition and equality. This is reflected in the procedures and methods adopted for concluding public contracts, starting with the preparation of the terms of reference and the announcement of the desire to contract, up to the approval and validation of the contract, supported by administrative and judicial oversight mechanisms applied to public procurement. However, practical reality has revealed shortcomings in the effectiveness of these procedures and their insufficiency in curbing violations during the conclusion of public procurement contracts.

Les mesures préventives dans l'incarnation de la concurrence libre dans le domaine des marchés publics figurent parmi les principes les plus importants que les systèmes juridiques en Algérie ont cherché à consacrer. Le législateur algérien a accordé une grande attention à l'idée de consacrer la liberté de concurrence dans le domaine des marchés publics à travers des réglementations juridiques, notamment le Règlement des marchés publics, la Loi sur la concurrence, la Loi sur la prévention et la lutte contre la corruption, et le Code pénal. La dernière évolution législative est la Loi 23-12 relative à l'organisation des marchés publics, qui a établi les principes de concurrence libre, transparente et d'égalité. Cela se reflète dans les procédures et les méthodes adoptées pour la conclusion des marchés publics, allant de la préparation des cahiers des charges et de l'annonce de l'intention de contracter jusqu'à l'approbation et la validation du marché, soutenues par des mécanismes de contrôle administratif et judiciaire appliqués aux marchés publics. Cependant, la réalité pratique a révélé des lacunes dans l'efficacité de ces procédures et leur insuffisance pour limiter les abus lors de la conclusion des marchés publics.
