الحماية القانونية للأجر في التشريع الجزائري

Abstract

تطور مفهوم الأجر وتطورتمعهوسائل حمايته بالنظرإلى الأهمية الت ييكتسبهاسواء من الناحية الاجتماعية أومن الناحية الاقتصادية،فبالنسبة للأهميةالاجتماعية هويعتبرالوسيلة التي يعتمد عليهاالأجيرفي حياته اليومية و معيشته، وبالنظر للدور الذي تلعبه في الحياة الاجتماعية للعامل تدخلت الدولة لفرض القواعد القانونية لحمايته من تعسف صاحب العمل، ولقد بلغت هذه الحماية إلى حد اعتبار الأجر من مسائل النظام العام، والتي لايمكن الاتفاق على مخالفتها فيما يتعلقب طرق تحديده و كيفيات دفعه، ووضع حد أدنى لهيتمتحديدهمركزيا،حيثتمنعالتشريعات العمالية النزولعنهإلىجانبوسائلحمايةتضمن استقرارالدفع واستحقاق الأجروملحقاته والعناصرالمكونة له لأنها جزء لا يتجزأ من الأجر. و هو ما كرسه المشرع الجزائري من خلال تبني قواعد الحماية و الآليات التي تضمن الوفاء بالأجر بدءا بجعـل العمـل حقا دستوريا لكل مواطن وضمن لهم الأمنوالحماية الـتي تجسـدت في المراسـيم والأوامـر والضمانات المختلفـة الـتي وضــعت قواعــد لتنظــيم علاقــة العمــل عامــة والأجــر خاصــة.

And this is what the Algerian legislator has enshrined by adopting the rules of protection and mechanisms that guarantee the fulfillment of wages, starting with making work a constitutional right for every citizen and guaranteeing them security and protection embodied in the various decrees, orders and guarantees that set rules for regulating the work relationship in general and wages in particular.

La notion de salaire a évolué et les moyens de sa protection ont évolué avec lui compte tenu de l'importance que le salaire acquiert, que ce soit sur le plan social ou économique. En ce qui concerne l'importance sociale, il est considéré comme le moyen dont dépend le salarié. dans sa vie quotidienne et sa subsistance, et compte tenu du rôle qu'il joue dans la vie sociale du travailleur, l'État est intervenu pour imposer les règles Protection légale pour le protéger des abus de l'employeur, et cette protection a atteint le point de considérer le salaire d'ordre public, auquel il ne peut être dérogé quant aux modalités de sa détermination et de son versement, et fixant un salaire minimum à déterminer au niveau central, là où la législation du travail interdit qu'il soit réduit à assurer la stabilité du paiement et du droit au salaire et à ses annexes et composantes parce qu'il fait partie intégrante du salaire. Et c'est ce que le législateur algérien a consacré en adoptant les règles de protection et les mécanismes qui garantissent l'accomplissement du salaire, à commencer par faire du travail un droit constitutionnel pour chaque citoyen et lui garantir sécurité et protection incarnées dans les différents décrets, ordonnances et garanties qui fixent des règles pour réglementer la relation de travail en général et les salaires en particulier.
