دور الجماعات المحلية في دعم وتشجيع الاستثمار المحلي في ضوء التشريع الجزائري

Abstract

يشكل الاستثمار المحلي تحديا كبيرا للجماعات المحلية، كما أنه يعتبر عملية ديناميكية تفاعلية بين الجهاز العمومي ومختلف مكونات المجتمعات المحلية، وتعتبر الجماعات المحلية أحد أهم أساليب تنظيم الدولة وتحقيق اللامركزية بتوزيع الوظيفة الإدارية بين الهيئات المركزية وأجهزة تنفيذية محلية. وفي إطار السياسة الاقتصادية المعتمدة من قبل الدولة الجزائرية لمواجهة مشاكل الوضع الاقتصادي والاجتماعي الحالي، أصبح يعول كثيرا على تبني سياسة الاستثمار المحلي بالاعتماد على الجماعات المحلية، وقد تجسدت هذه الرؤية من خلال إصدار قوانين المنظمة للجماعات المحلية والتي منحت العديد من الصلاحيات لهذه الأجهزة في مجال التنمية الاجتماعية والاقتصادية بما فيها تدعيم الاستثمار المحلي عن طريق اعتماد مجموعة من الآليات القانونية والجبائية.

Local investment poses a significant challenge for local communities and is considered a dynamic interactive process between public bodies and various components of local communities. Local authorities are one of the most important means of organizing the state and achieving decentralization by distributing administrative functions between central bodies and local executive agencies. In the context of the economic policy adopted by the Algerian state to address the current economic and social issues, there is a strong reliance on the adoption of local investment policies based on local communities. This vision has been realized through the issuance of laws regulating local communities, which have granted numerous powers to these bodies in the field of social and economic development, including supporting local investment through the adoption of a set of legal and fiscal mechanisms

L'investissement local constitue un défi majeur pour les collectivités locales et est considéré comme un processus dynamique et interactif entre les organismes publics et les diverses composantes des communautés locales. Les collectivités locales sont l'un des moyens les plus importants d'organiser l'État et de réaliser la décentralisation en répartissant les fonctions administratives entre les organismes centraux et les agences exécutives locales. Dans le cadre de la politique économique adoptée par l'État algérien pour faire face aux problèmes économiques et sociaux actuels, il y a une forte dépendance à l'adoption de politiques d'investissement local basées sur les collectivités locales. Cette vision s'est concrétisée par la promulgation de lois régissant les collectivités locales, qui ont accordé de nombreux pouvoirs à ces organismes dans le domaine du développement social et économique, y compris le soutien à l'investissement local par l'adoption d'un ensemble de mécanismes juridiques et fiscaux.
