الجرائم الاقتصادية عبر الشبكة المعلوماتية وآليات مكافحتها دراســة ميـدانيــة

Abstract

في ظل انتشار عالم المعلومات والانترنت، مما جعل الفضاء الخارجي هامش للتحرك غير المرئي ،و ساهم هذا التطور في انعكاسه الايجابي من جهة على عالم المال والاقتصاد الذي أصبح يعتمد بدوره التقنية والتطور الحديث في ظل سيطرة العولمة الاقتصادية على الحياة الكونية وجعلها قرية صغيرة وانعكاسه السلبي من جهة أخرى الذي قابل هذا التطور الاقتصادي من خلال ظهور نوع جديد من الجرائم تسمى الجرائم الإقتصادية عبر الشبكة المعلوماتية وهي من أحدث أنواع الجرائم التي تسبب ضررا كبيرا لاقتصاديات الدول التي أصبحت مترابطة سيبرانية عن طريق الفضاء الإلكتروني الإفتراضي ووسائل الاتصال الحديثة ومنها بالطبع الجزائر، والتي لم تسلم في السنوات الفارطة من موجة الجرائم الإلكترونية والتي ارتفعت وتيرتها بشكل تصاعدي خاصة تلك الجرائم التي تهدف بالأساس إلى الإضرار بالأنظمة الحاسوبية والإلكترونية والتجسس على المعلومات الخاصة بالشركات والمؤسسات الإقتصادية أو التجارية أو المالية كالبنوك ، الترسانة القانونية التي جاء بها المشرع الجزائري لمعالجة هذا النوع من الجرائم تعتبر غير فعالة ، فرغم عدم وجود إحصائيات دقيقة عن الخسائر الاقتصادية التي تتكبدها البلاد سنويا بسبب الأضرار المادية الكبيرة التي يسببها هذا النوع من الهجمات الإلكترونية ولكن الأرقام والإحصائيات العالمية تقول بأنه خلال العام الماضي خسر الاقتصاد العالمي أكثر من 600 مليار دولار من جراء الهجمات الإلكترونية التي تستهدف الأنظمة المعلوماتية والحاسوبية لمختلف الدول بما فيها الجزائر طبعأ،وهي مرشحة للارتفاع بحلول العام 2020 اذا لم يتم اتخاذ الإجراءات اللازمة وفي الوقت المناسب للتقليل منها ولما لا الحد منها،وسنحاول في بحثنا هذا التطرق إلى مكافحة الجرائم الإقتصادية عبر الشبكة المعلوماتية ومن ثم التعريف بماهية الجريمة الالكترونية وما هي الآليات الكفيلة بمكافحتها. الكلمات المفتاحية: ، ، Absract within the spread of the information and Internet world’s, making outer space a fringe of invisible motion, this development contributed to its positive reflection on the one hand on the finance and economy word which has become dependent in turn on technology and modern development under the control of economic globalization on cosmic life and make it a small village and its negative impact on the other side which met this economic development through the emergence of a new type of crime called The economic crimes through the Internet ; It is the latest types of crimes that cause great harm to the economies of the countries that have become connected Cybernia through cyberspace and modern means of communication, including Algeria, which has not been delivered in recent years of the wave of cyber crimes, which rose rapidly, especially those crimes Which aims primarily at damaging computer and electronic systems and spying on the information of companies and economic, commercial or financial institutions such as banks, The legal arsenal provided by the Algerian legislator to deal with this type of crime is ineffective. Despite the lack of accurate statistics on the economic losses incurred by the country annually due to the great physical damage caused by this type of electronic attacks,But global figures and statistics say that last year the global economy lost more than $ 650 billion in cyber attacks targeting computer and computer systems of different countries, including Algeria, we will try in our research that address the combating economic crimes commited through the internet and the definition of what the cyber-crime and what the mechanisms toensure combating it.
