الجوانب الإجرائية لعقود المحروقات في التشريع الجزائري

Abstract

تعد عقود المحروقات من اهم العقود، لذلك خصها المشرع بجملة من الإجراءات القانونية والتنظيمية، فتبدأ هذه الإجراءات بمراحل تحضيرية تشمل انتقاء المساحات التعاقدية، ثم تليها منح شهادة التأهيل الاولي للمتعاملين المؤهلين، بعدها تبدأ مراحل الابرام، من خلال الإعلان عن المنافسة ثم تتشكل لجنة المناقصة للمنافسة، ثم يتم تقديم العروض وتقييمها، ثم التوقيع على العقد والمصادقة عليه، غير ان هناك استثناء يتمثل في اللجوء الى التفاوض المباشر.
