Abstract

اللجنة العليا الوطنية للطعون المتعلقة بالاستثمار، هي لجنة تتكفل بالفصل في الطعون المقدمة من طرف المستثمر، ضد قرارات الوكالة الجزائرية لترقية الاستثمار المتعلقة برفض منح مزايا أو سحبها، أو ضد قرارات الهيئات والادارات العمومية المكلفة بتفنيد أحكام قانون الاستثمار في حالة عدم إعدادها للمقررات والوثائق والتراخيص، وتعتبر اللجنة ضمانة من ضمانات قانون الاستثمار، فهي تساهم في حماية حقوق المستثمر وتعزز من ثقته، كما ان لها دور في حل بعض المسائل المرتبطة بالعملية الاستثمارية من خلال تقديمها لتقارير دورية لرئيس الجمهورية و تقديم توصيات عند الاقتضاء، وقراراتها نافذة وملزمة وهي قابلة للطعن أمام القضاء الاداري، ولجوء المستثمر اليها يعد أمرا اختياريا، كما أن المستثمر لا يفقد حقه في اللجوء الى القضاء في حال ما اختار تقديم طعنه أمام اللجنة.

The National High Committee for Investment Appeals is a body responsible for ruling on appeals submitted by investors against decisions made by the Algerian Investment Promotion Agency regarding the refusal or withdrawal of incentives, or against decisions of public bodies and administrations responsible for implementing the provisions of the Investment Law, in cases where they fail to issue the necessary decisions, documents, and authorizations. The Committee serves as one of the guarantees provided by the Investment Law. It contributes to the protection of investors' rights and reinforces their confidence. It also plays a role in resolving certain issues related to the investment process by submitting periodic reports to the President of the Republic and offering recommendations when necessary. Its decisions are binding and enforceable, and they may be appealed before the administrative courts. Recourse to the Committee is optional for investors, and choosing to submit an appeal to the Committee does not deprive the investor of the right to take the matter to court.
