المسؤولية الجزائية عن الجرائم الاقتصادية

Abstract

تهدف هذي الدراسة الى تسليط الضوء على المسؤولية الجزائية الناشئة عن الجرائم الاقتصادية من حيث خصوصية أركانها وذلك بالتركيز على اشكاليات تفسير النصوص القانونية وتحديد العلاقة السببية وإثبات النية الجرمية فيها، كما تطرقنا إلى نطاق المسؤولية الجزائية بمساءلة الغير ومسؤولية الشخص المعنوي مع شروط قيامها، مع التركيز على القواعد الإجرائية ومدى فاعلية المشرع الجزائري في وضعه لأحكام قانونية لهذا النوع من الجرائم وفرض عقوبات جنائية للحد. منها. ولقد تزصلنا في هذي الدراسة إلى أن الجرائم إقتصادية تحتاج إلى قواعد قانونية خاصة وذلك بالخروج عن القواعد العامة المنصوص عليها في قانون العقوبات وفرض جزاءات إدارية ومدنية وتأديبية إلى جانب الجزاءات الجنائية لإزالة التجريم والحد من الجريمة واشتراك السلطة التنفيذية في وضع النصوص التنظيمة في اطار التفويض التشريعي

This study aims to highlight the criminal responsibility arising from economic crimes in terms of the privacy of its pillars, by focusing on the problems of interpreting legal texts and determining the causal relationship and proving the criminal intention in it, as we touched on the scope of criminal responsibility with accountability of others and the responsibility of the moral person with the conditions of its establishment, with a focus on the procedural rules and the extent of the effectiveness of the Algerian legislator in setting legal provisions for this type of crime and imposing Criminal penalties for limit. From it. In this study, we have been attributed to the fact that economic crimes need special legal rules by deviating from the general rules stipulated in the Penal Code and imposing administrative, civil and disciplinary penalties in addition to criminal penalties to remove criminalization and reduce crime and the participation of the executive authority in developing organized texts within the framework of the legislative mandate.

Cette étude vise à éclairer la responsabilité pénale découlant des crimes économiques en termes de spécificité de leurs éléments en se concentrant sur les problèmes d’interprétation des textes juridiques, de détermination du lien de causalité et de preuve de l’intention criminelle. Nous avons également abordé la portée de la responsabilité pénale en tenant autrui responsable et la responsabilité de la personne morale avec les conditions de sa création, en mettant l’accent sur les règles de procédure et le degré d’efficacité du législateur algérien dans l’établissement de dispositions légales pour ce type de crime et l’imposition de sanctions pénales pour le limiter. De là. Dans cette étude, nous avons conclu que les crimes économiques nécessitent des règles juridiques spéciales, en s'écartant des règles générales stipulées dans le Code pénal et en imposant des sanctions administratives, civiles et disciplinaires en plus des sanctions pénales pour supprimer la criminalisation et réduire la criminalité, et la participation du pouvoir exécutif à l'élaboration des textes réglementaires dans le cadre de l'autorisation législative.
