التحكيم الدولي في عقود البترول

Abstract

يعد التحكيم الدولي وسيلة بديلة وفعالة لحل النزاعات الدولية في عقود البترول، لما يوفره من مرونة وخصوصية مقارنة بالقضاء التقليدي، مع إمكانية اختيار القانون الواجب التطبيق ومراكز التحكيم مثل ICCو ICSID في الجزائر، تنظمه أحكام القانونين 22-13 و19-13، مع مراعاة السيادة الوطنية وقابلية تنفيذ الأحكام أمام القضاء الوطني، كما يظهر في لجوء شركة سوناطراك إلى التحكيم لضمان وحماية مصالح الأطراف.
