الخطورة الإجرامية ودورها في السياسة الجنائية المعاصرة

Abstract

الخطورة الإجرامية من العوامل الأساسية التي أدت الى التحول الجوهري للسياسة الجنائية من سياسة عقابية تقليدية إلى سياسة وقائية وقد أظهر التطبيق العملي قصور السياسة العقابية في الحد من هذه الخطورة إذ لم تعد العقوبة وحدها كافية لمنع الجاني من العود للإجرام مما دفع المشرع الى تبني نهج جديد يقوم على إصلاح الجاني و إعادة تأهيله بدلاً من الاقتصار على العقاب فقط وذلك من خلال اعتماد التدابير الأمنية وآليات إعادة التأهيل والإدماج داخل المؤسسات العقابية.

La dangerosité Criminelle a constitué la cause principal du changement fondamental de la politique criminelle, passant d'une politique préventive, traditionnelle à une politique préventive. En effet, la politique répressive s'est révélée insuffisante pour limiter cette dangerosité, la peine n'étant plus capable d' empêcher le délinquant de récidiver. Cela a conduit le législateur à adopter une approche axée sur la réinsertion et la rééducation du délinquant, plutôt que sur la seule punition, à travers la mise en œuvre de mesures de sureté et de mécanismes de réhabilitation et de réintégration sociale au sein des institutions pénitentiaires.

Criminal dangerousness has been the main factor behind the fundamental shift of criminal policy from a traditional punitive approach to a preventive one, the punitive policy proved insufficient to reduce this dangerousness, as punishment alone was no longer effective in preventing offenders from reoffending. This led the legislator to adopt an approach focused on the rehabilitation and reintegrating the offender, rather than mere punishment, through the implementation of security measures and mechanisms of rehabilitation and social reintegration within correctional institutions.
