مكافحة الجريمة المنظمة في ظل الأقطاب الجزائية

Abstract

تعتبر الجريمه المنظمه من الظواهر المعقده في السنوات الاخيره وما زاد تعقيدها هو سرعه التطورها ومواكبه في ذلك التقدم العلمي لكن بالتعرض الى ابرز التعريفات تله وتحديد مجاري نشاطها وكذلك تميزها عن غيرها من الجرائم مما يجعل من مهمه التصدي لها ومكافحتها امرا اقل صعوبه على المستوين الوطني والدولي تعتبر الأقطاب الجزائية المتخصصة في التشريع الجزائري أداة هامة في مكافحة الجريمة المنظمة، حيث يتمثل دورها في توفير الحماية للمواطنين والممتلكات من خلال محاربة الجرائم الخطيرة. يمكن أن تساهم هذه الأقطاب في تعزيز الأمن والاستقرار في المجتمع، ولكن يبقى التحدي في كيفية تطبيق الإجراءات والآليات الأساسية لعملها بشكل فعال دون المساس بالحقوق الأساسية. يبدو أن المشرع الجزائري قد اتجه إلى تكريس إجراءات استثنائية في هذا السياق، مما قد يطرح تساؤلات حول التوازن بين مكافحة الجريمة وحماية الحقوق. Organized crime is considered one of the most complex phenomena in recent years, and its complexity has increased due to its rapid development in parallel with scientific advancement. However, by addressing its main definitions, identifying its areas of activity, and distinguishing it from other types of crime, the task of combating it becomes less difficult at both the national and international levels. Specialized criminal poles in Algerian legislation are regarded as a key tool in the fight against organized crime. Their role is to protect citizens and property by combating serious crimes. These poles can contribute to enhancing security and stability in society. However, the challenge lies in how to implement the fundamental procedures and mechanisms effectively without infringing on basic rights. The Algerian legislator seems to be moving towards the adoption of exceptional procedures in this context, raising questions about the balance between fighting crime and protecting rights. La criminalité organisée est considérée comme l’un des phénomènes les plus complexes de ces dernières années, et sa complexité s’est accrue en raison de sa rapide évolution, accompagnant ainsi les avancées scientifiques. Cependant, l’examen de ses principales définitions, la délimitation de ses domaines d'activité, ainsi que sa distinction par rapport aux autres types de criminalité, rendent la lutte contre ce phénomène moins difficile aux niveaux national et international. Les pôles pénaux spécialisés dans la législation algérienne sont considérés comme un outil important dans la lutte contre la criminalité organisée. Leur rôle est d’assurer la protection des citoyens et des biens en combattant les crimes graves. Ces pôles peuvent contribuer à renforcer la sécurité et la stabilité dans la société. Toutefois, le défi réside dans la mise en œuvre efficace des procédures et mécanismes fondamentaux sans porter atteinte aux droits fondamentaux. Le législateur algérien semble s’orienter vers l’adoption de procédures exceptionnelles, ce qui soulève des interrogations quant à l’équilibre entre la lutte contre la criminalité et la protection des droits.
