ضمانات وحوافز الإستثمار في ضوء القانون 22-18

Abstract

يتناول هذا البحث دراسة الضمانات والأنظمة التحفيزية التي أقرها القانون 18/22 لترقية الاستثمار في الجزائر. يركز الفصل الأول على الضمانات الموضوعية، كالثبات التشريعي وحرية الاستثمار، والضمانات المالية مثل حماية تحويل رؤوس الأموال وحقوق الملكية الفكرية. كما يعالج الضمانات الإجرائية من خلال آليات التسوية القضائية وشبه القضائية لمنازعات الاستثمار. أما الفصل الثاني، فيتناول الأنظمة التحفيزية المستحدثة، ومنها نظام القطاعات، نظام المناطق، ونظام الاستثمارات المهيكلة، إضافة إلى دور التسجيل كمفتاح أساسي للحصول على الامتيازات. يبرز البحث أهمية الشبابيك الوحيدة والمنصات الرقمية في تسهيل الإجراءات الإدارية. ويختتم بدراسة آثار التسجيل، من حيث الحقوق الممنوحة للمستثمرين والالتزامات المترتبة عليهم. يهدف البحث إلى تقييم فعالية القانون في جذب الاستثمار وتعزيز الثقة في المناخ الاقتصادي الجزائري. ا

The first chapter focuses on substantive guarantees, such as legislative stability and freedom of investment, as well as financial guarantees like the protection of capital transfer and intellectual property rights. It also addresses procedural guarantees through judicial and quasi-judicial mechanisms for resolving investment disputes. The second chapter discusses newly introduced incentive systems, including the sectoral regime, the regional zones regime, and structured investments, in addition to the role of registration as a key to obtaining benefits. The study highlights the importance of single windows and digital platforms in facilitating administrative procedures. It concludes by examining the effects of registration, including investors' rights and obligations. The research aims to assess the effectiveness of the law in attracting investment and enhancing confidence in Algeria’s economic climate.

Cette recherche examine les garanties et les régimes incitatifs mis en place par la loi 18/22 pour promouvoir l'investissement en Algérie. Le premier chapitre porte sur les garanties substantielles, telles que la stabilité législative et la liberté d'investir, ainsi que sur les garanties financières comme la protection du transfert des capitaux et des droits de propriété intellectuelle. Il traite également des garanties procédurales à travers les mécanismes judiciaires et quasi-judiciaires de règlement des litiges en matière d’investissement. Le deuxième chapitre aborde les régimes incitatifs nouvellement introduits, notamment le régime sectoriel, le régime des zones et les investissements structurés, en plus du rôle de l’enregistrement comme clé d’accès aux avantages. L’étude met en évidence l’importance des guichets uniques et des plateformes numériques dans la simplification des procédures administratives. Elle se conclut par l’examen des effets de l’enregistrement, notamment les droits et obligations des investisseurs. La recherche vise à évaluer l’efficacité de la loi dans l’attraction des investissements et le renforcement de la confiance dans le climat économique algérien.
