عقود استغلال نشاط المحروقات في ظل القانون رقم 19-13

Abstract

تعتبر المحروقات المتواجدة على أقاليم الدولة الجزائرية ملك للمجموعة الوطنية, حيث تكلف هيئات بإدارة هذه الثروة من مرحلة اكتشافها إلى غاية استخراجها وجعلها قابلة للاستهلاك المباشر من طرف الإنسان, و نظرا لما يعرفه نشاط المحروقات من تقنيات و خبرات بالإضافة إلى استثمار رؤوس أموال ضخمة, و التي غالبا ما تكون الدولة تفتقدها تسعى هذه الأخيرة لإبرام عقود المحروقات مع الشركات الأجنبية المتخصصة و الرائدة في هذا المجال لاستغلال هذه الثروة.

The hydrocarbons located on the territories of the Algerian state are considered the property of the national group where bodies are tasked with managing this wealth from the stage of its discovery until extraction and making it usable for direct consumption by humans, and due to the well-known hydrocarbon activity of technologies and expertise in addition to investing huge capital, which the state often lacks, the latter seeks to conclude contracts for hydrocarbons with foreign specialized and leading companies in this field to exploit this wealth.

Les hydrocarbures situés sur les territoires de l'Etat algérien sont considérés comme la propriété du groupe national, où des organismes sont chargés de gérer cette richesse depuis le stade de sa découverte jusqu'à son extraction et de la rendre utilisable pour une consommation directe par l'homme, et en raison de l'activité hydrocarbonée bien connue des technologies et de l'expertise en plus d'investir d'énormes capitaux, dont l'Etat manque souvent, ce dernier cherche à conclure des contrats d'hydrocarbures avec des sociétés étrangères spécialisées et leaders dans ce domaine pour exploiter cette richesse
