Abstract

تعامل العالم في الوقت الحالي مع الكثير من التطورات التي تحدث في مختلف المجالات العلمية والعملية ، والتي تدفع المشرع في مواكبة هده التطورات تشريعا خاصة تلك المتعلقة بالأعمال التجارية استجابة المشرع الجزائري لهده التطورات وقام بإنشاء هيئة قضائية تكون لها سلطة الفصل في المنازعات التجارية التي قد تحدث تحت مسمى المحاكم التجارية المتخصصة ودلك بموجب القانون رقم 22-13 المعدل والمتمم لقانون 08-09 المتعلق بقانون الاجراءات المدنية والإدارية ، بالإضافة إلى وجود قضاة متخصصين ذو كفاءة ومساعدين لهم خبرة واسعة في الأعراف التجارية ، وتفعيل دور الوسائل البديلة لحل النزعات باعتماد الصلح كإجراء وجوبي شكلي أمام المحاكم التجارية المتخصصة

Le monde est actuellement confronté à de nombreuses évolutions dans divers domaines scientifiques et pratiques, ce qui pousse le législateur à adapter la législation, notamment en ce qui concerne les activités commerciales. Le législateur algérien a répondu à ces évolutions en instituant une juridiction compétente pour trancher les litiges commerciaux, sous l’appellation de tribunaux commerciaux spécialisés, et ce, en vertu de la loi n° 22-13 modifiant et complétant la loi n° 08-09 relative au code de procédure civile et administrative. Ces juridictions sont composées de juges spécialisés compétents, assistés par des experts ayant une vaste expérience dans les usages commerciaux. En outre, le rôle des modes alternatifs de règlement des litiges a été renforcé, notamment par l’adoption de la conciliation comme procédure préalable obligatoire devant les tribunaux commerciaux spécialisés.

The world is currently witnessing numerous developments across various scientific and practical fields, prompting legislators to adapt legislation, particularly concerning commercial activities. In response to these developments, the Algerian legislator has established specialized judicial bodies, known as Specialized Commercial Courts, with the authority to adjudicate commercial disputes. This was enacted under Law No. 22-13, which amends and supplements Law No. 08-09 related to the Code of Civil and Administrative Procedures. This framework includes specialized and competent judges, along with assistants possessing extensive experience in commercial customs. Furthermore, the role of alternative dispute resolution (ADR) methods has been activated, with conciliation adopted as a mandatory formal procedure before these Specialized Commercial Courts.
