الضبط في التشريعات الجزائرية: الدور المستحدث للدولة

Abstract

سعت الدولة الجزائرية لمواكبة تطور دور الدولة وانتقالها نحو الدولة الضابطة، من خلال تبني مفاهيم جديدة حول الوظائف الرئيسة لها و إضافة عناصر جديدة للنظام العام الذي يعتبر الحفاظ عليه عماد دور الدولة منذ نشأتها و قد انشأ المشرع الجزائري في سبيل القيام بهذا الدور المستحدث أجهزة مخصصة لذلك في مختلف المجالات. وخص هذه السلطات المستحدثة ومن بينها مجلس المنافسة (انموذجا) بنظام قانوني متميز في سبيل قيامه بالمهام المخولة له، ابتداء من وضع الضوابط والتنظيمات ثم السهر على تطبيقها واحترامها إضافة إلى الدور الوقائي والاستشاري.

L’État algérien cherche à suivre le développement du rôle de l’État et sa transition vers un État régulateur, En adoptant de nouveaux concepts sur ses fonctions principales et en ajoutant de nouveaux éléments à l’ordre public, dont sa préservation est considérée comme le pilier du rôle de l’État. Afin de remplir ce nouveau rôle, le législateur algérien a créé des organes dédiés à cet objectif dans différents domaines. Ces nouvelles autorités, y compris le Conseil de la concurrence (comme modèle), se sont vu attribuer un système juridique distinct afin d’accomplir les tâches qui lui ont été assignées. En commençant par établir des contrôles et des réglementations, puis en assurer la mise en œuvre et le respect, en plus du rôle préventif et consultatif.

The Algerian State seeks to follow the development of the role of the State and its transition to a regulatory State, by adopting new concepts on its main functions and adding new elements to public order, whose preservation is seen as the cornerstone of the role of the state. In order to fulfil this new role, the Algerian legislator has created bodies dedicated to this objective in different areas. These new authorities, including the Competition Council (as a model), have been given a separate legal system to carry out their assigned tasks. Starting with establishing controls and regulations, then ensuring implementation and compliance, in addition to the preventive and advisory role.
