الحمايــــة القانونيــــة للمسنين

Abstract

تناولنا في هذه الدراسة قضية من أهم القضايا الإنسانية والأخلاقية وهي حماية المسنين والتكفل بهم، حيث تعتبر فئة المسنين من الفئات الضعيفة والهشة في المجتمع لذلك سعت الدولة الجزائرية إلى توفير حماية قانونية للمسنين من خلال اتخاذ آليات وتدابير قانونية تضمن البقاء في وسطهم الأسري والتمتع بحقوقهم وعدم تعرضهم للإهمال، وتضمن لهم تكفل أسري واجتماعي ومادي سواء على مستوى الأسرة أو على مستوى الدولة بمؤسساتها وهياكلها وأجهزتها.

In this study, we investigated one of the most important humanitarian and ethical issues, namely the protection and care of the elderly, as they are considered one of the weakest and most fragile groups in society. The Algerian state has therefore provided legal protection to the elderly by adopting legal mechanisms and measures that guarantee their continued presence in their family environment, the enjoyment of their rights, and non-neglect. It also guarantees them family, social, and material care, whether at the family level or at the state level, with its institutions, structures, and agencies.

Dans cette étude, nous avons étudié l’un des sujets humanitaires et éthiques les plus importants, à savoir la protection et les soins des personnes âgées, car elles sont considérées comme l’un des groupes les plus faibles et les plus fragiles de la société. L’état algérien a donc assurée une protection juridique aux personnes âgées en adoptant des mécanismes et des mesures juridiques qui garantissent leur présence continue dans leur environnement familial, la jouissance de leurs droits et la non-négligence. Elle leur garantit également une prise en charge familiale, sociale et matérielle, que ce soit au niveau familial ou au niveau de l’État, avec ses institutions, ses structures et ses agences.
