تنظيم براءة الاختراع في التشريع الجزائري

Abstract

براءة الاختراع هي حق حصري يمنح للمخترع لاستغلال اختراعه لمدة 20 سنة غير قابلة للتجديد، بشرط أن يكون جديدا، مبتكرا، وقابلا للتطبيق الصناعي، وألا يخالف النظام العام. في الجزائر، يتولى المعهد الوطني للملكية الصناعية (INAPI) فحص طلبات البراءة ومنحها بعد استيفاء الشروط. تتم حماية براءات الاختراع من التقليد والمنافسة غير المشروعة من خلال: -الحماية المدنية: برفع دعاوى لوقف الانتهاك والتعويض. -الحماية الجنائية: بفرض عقوبات مثل السجن والغرامات ومصادرة المنتجات المقلدة. ودوليا، تعزز الحماية عبر اتفاقيات مثل: -اتفاقية باريس: لضمان المعاملة الوطنية وأولوية الإيداع. -اتفاقية تريبس (TRIPS): لحماية حقوق المخترعين الأجانب. -اتفاقية الويبو (WIPO): لدعم حماية الملكية الفكرية عالميا، خصوصا في الدول النامية. تهدف هذه الآليات إلى تشجيع الإبداع، حماية حقوق المخترعين، ومنع التزوير والمنافسة غير النزيهة.

A patent is an exclusive right granted to an inventor to exploit their invention for a period of 20 years, non-renewable, provided that the invention is new, involves an inventive step, is industrially applicable, and does not violate public order. In Algeria, the National Institute of Industrial Property (INAPI) is responsible for examining patent applications and granting them once the required conditions are met. Patent protection against imitation and unfair competition is ensured through: -Civil protection: by filing lawsuits to stop infringement and claim compensation. -Criminal protection: by imposing penalties such as imprisonment, fines, and the confiscation of counterfeit products. Internationally, protection is reinforced through agreements such as: -The Paris Convention: to guarantee national treatment and the right of priority for filing. -The TRIPS Agreement: to protect the rights of foreign inventors. -The WIPO Convention: to support global intellectual property protection, especially in developing countries. These mechanisms aim to encourage innovation, protect inventors’ rights, and prevent counterfeiting and unfair competition. .

Le brevet d'invention est un droit exclusif accordé à l’inventeur pour exploiter son invention pendant une durée de 20 ans non renouvelable, à condition qu’elle soit nouvelle, inventive, applicable industriellement et qu’elle ne contrevienne pas à l’ordre public. En Algérie, c’est l’Institut National Algérien de la Propriété Industrielle (INAPI) qui examine les demandes de brevet et les accorde après vérification des conditions requises. La protection des brevets contre la contrefaçon et la concurrence déloyale s’effectue à travers : -La protection civile : par des actions en justice visant à faire cesser la violation et à obtenir réparation. -La protection pénale : par des sanctions telles que l’emprisonnement, des amendes et la saisie des produits contrefaits. Au niveau international, la protection est renforcée par des conventions telles que : -La Convention de Paris : pour garantir le traitement national et le droit de priorité. -L’Accord sur les ADPIC (TRIPS) : pour protéger les droits des inventeurs étrangers. -La Convention de l’OMPI (WIPO) : pour soutenir la protection de la propriété intellectuelle à l’échelle mondiale, notamment dans les pays en développement. Ces mécanismes visent à encourager l’innovation, protéger les droits des inventeurs, et lutter contre la contrefaçon et la concurrence déloyale.
