Abstract

تناولت هذه المذكرة آليات الرقابة الجمركية على الحوافز الجبائية المقرّرة لفائدة المستثمرين في قطاع المحروقات وفق القانون 19 -13 المتعلق بنشاطات المحروقات، فقد جاء هذا القانون ليكرّس نظاما جبائياً وجمركياً تحفيزياً خاصاً لاسيما المادتين 217.218 منه ، مع التركيز على ضمان التوازن بين تشجيع الاستثمار وحماية المال العام من خلال رقابة فعالة على الامتيازات وشروط استخدامها مع ذكر التحديات التي تواجه فعالية الرقابة القبلية واللاحقة لضمان تحقيق التوازن بين تشجيع الاستثمار وحماية المال العام .

This studyexamined the mechanisms of customs control over tax incentives granted to investors in the hydrocarbons sector under Law 19-13 on petroleum activities. This law established a special incentivized tax and customs regime, particularly under Articles 217 and 218, while emphasizing the need to strike a balance between encouraging investment and safeguarding public funds through effective oversight of exemptions and their conditions of use. The study also highlighted the challenges facing the effectiveness of prior and subsequent controls to ensure this balance is maintained.

Cette etude les mécanismes de contrôle douanier relatifs aux incitations fiscales accordées aux investisseurs dans le secteur des hydrocarbures conformément à la loi 19-13 sur les activités pétrolières. Cette loi a instauré un régime fiscal et douanier incitatif spécifique, notamment aux articles 217 et 218, tout en mettant l’accent sur l’équilibre entre la promotion de l’investissement et la protection des fonds publics grâce à un contrôle efficace des avantages et des conditions de leur utilisation. L’étude a également souligné les défis liés à l’efficacité des contrôles préalables et a posteriori pour garantir cet équilibre.
