دور لجان الصفقات العمومية في تجسيد المشاريع الاستثمارية على مستوى الولاية

Abstract

تهدف هذه المذكرة إلى دراسة الدور المحوري الذي تؤديه لجان الصفقات العمومية في تجسيد المشاريع الاستثمارية على مستوى الولاية، وذلك من خلال تحليل مهامها، آليات عملها، ومدى فعاليتها في تسيير الموارد العمومية وضمان الشفافية في منح الصفقات. تطرقت الدراسة إلى الإطار القانوني المنظم للصفقات العمومية في الجزائر، لاسيما المرسوم الرئاسي رقم 15-247 المتعلق بتنظيم الصفقات العمومية وتفويضات المرفق العام، بالإضافة إلى المراسيم التنظيمية المكملة. كما تم تحليل هيكلة لجان الصفقات، أنواعها (اللجنة الولائية...)، واختصاصاتها في دراسة العروض والمصادقة على المشاريع، بحيث أظهرت النتائج أن لجان الصفقات العمومية تساهم بفعالية في ضمان الشفافية والمنافسة بين العارضين، لكنها تعاني في المقابل من بعض العراقيل، مثل طول آجال الدراسة والمصادقة، وضعف التنسيق بين مختلف المتدخلين، مما ينعكس سلبًا على تجسيد بعض المشاريع الاستثمارية في الآجال المحددة.

Ce mémoire vise à étudier le rôle central joué par les commissions des marchés publics dans la concrétisation des projets d’investissement au niveau de la wilaya, à travers l’analyse de leurs missions, leurs mécanismes de fonctionnement, ainsi que leur efficacité dans la gestion des ressources publiques et la garantie de la transparence dans l’attribution des marchés. L’étude a abordé le cadre juridique régissant les marchés publics en Algérie, notamment le décret présidentiel n° 15-247 relatif à la réglementation des marchés publics et des délégations de service public, ainsi que les décrets réglementaires complémentaires. La structure des commissions des marchés, leurs types (commission de wilaya...), et leurs compétences en matière d’analyse des offres et d’approbation des projets ont également été analysées. Les résultats ont montré que les commissions des marchés publics contribuent efficacement à garantir la transparence et la concurrence entre les soumissionnaires. Toutefois, elles rencontrent certaines difficultés, telles que la longueur des délais d’étude et d’approbation, ainsi que le manque de coordination entre les différents intervenants, ce qui impacte négativement la réalisation de certains projets d’investissement dans les délais fixés.

This dissertation aims to study the pivotal role played by public procurement committees in the implementation of investment projects at the provincial level. It does so by analyzing their tasks, working mechanisms, and their effectiveness in managing public resources and ensuring transparency in the awarding of contracts. The study addresses the legal framework governing public procurement in Algeria, particularly Presidential Decree No. 15-247 related to the regulation of public contracts and public service delegations, in addition to the complementary regulatory decrees. The structure of procurement committees, their types (such as the provincial committee), and their responsibilities in evaluating bids and approving projects were also analyzed. The results show that public procurement committees effectively contribute to ensuring transparency and competition among bidders. However, they face certain obstacles, such as long evaluation and approval timelines, and weak coordination among various stakeholders, which negatively affects the timely implementation of some investment projects.
