إدارة هيئات الضمان الاجتماعي و اثرها على استقلاليتها في القانون الجزائري

Abstract

تتناول هذه المذكرة موضوع إدارة هيئات الضمان الاجتماعي وأثرها على استقلاليتها في السياق القانوني الجزائري، من خلال دراسة العلاقة بين آليات التسيير الإداري ودرجة الاستقلال المالي والتنظيمي التي تتمتع بها هذه الهيئات. من خلال التركيز على تطور هيئات الضمان الاجتماعي في الجزائر منذ الاستقلال، وتطور صلاحياتها، خاصة فيما يتعلق بآليات التمويل الذاتي عبر الاشتراكات الإلزامية، والإجراءات القانونية لتحصيلها، سواء وديًا أو قضائيًا، مع تمييزها الواضح عن الضرائب رغم النصوص القانونية التي تُقر بوجود نوع من الاستقلال الإداري والمالي، إلا أن تدخل الدولة من خلال وزارة العمل وسلطة الوصاية يبقى حاسمًا، خصوصًا فيما يخص تعيين الإطارات العليا، المصادقة على الميزانيات، وتوجيه السياسة العامة للضمان الاجتماعي.

This dissertation addresses the management of social security institutions and its impact on their autonomy within the Algerian legal framework. It explores the relationship between administrative management mechanisms and the degree of financial and organizational independence enjoyed by these bodies. The study highlights the development of social security institutions in Algeria since independence, and the evolution of their powers, particularly regarding self-financing mechanisms through mandatory contributions and the legal procedures for their recovery, whether amicable or judicial, with a clear distinction from taxation. Although legal texts provide for a certain degree of administrative and financial autonomy, the State’s intervention—especially through the Ministry of Labour and supervisory authority—remains decisive, particularly concerning the appointment of senior officials, approval of budgets, and direction of general social security policy.
