المركز القانوني للوكالة الجزائرية لترقية الاستثمار على ضوء القانون 22/18 المتعلق بالاستثمار

Abstract

تناولت هذه الدراسة الأكاديمية المركز القانوني للوكالة الجزائرية لترقية الاستثمار على ضوء القانون الجديد للاستثمار 22/18حيث تم تحليل الطبيعة القانونية للوكالة، ومختلف المهام المسندة إليها، أظهرت الدراسة أن المشرع الجزائري عزز من مكانة الوكالة بإعادة تنظيمها وتوسيع صلاحياتها وتغيير تسميتها من "الوكالة الوطنية لتطوير الاستثمار" إلى "الوكالة الجزائرية لترقية الاستثمار". كما أنشأ المشرع هياكل جديدة في إطار الوكالة تتمثل في الشباك الوحيد للمشاريع الكبرى والاستثمارات الأجنبية، والمنصة الرقمية للمستثمر، بهدف تبسيط الإجراءات وتسهيل الاستثمار. تبين أيضا أن فعالية الوكالة تتوقف على مدى قدرتها على تجاوز التحديات البيروقراطية وإرساء الشفافية في تسيير المزايا والضمانات المقدمة للمستثمرين، إضافة إلى تفعيل دورها كمرافق حقيقي للاستثمار من خلال وظائفها الإعلامية والتقنية.

Cette étude académique a porté sur le statut juridique de l'Agence algérienne de Promotion de l’Investissement à la lumière de la nouvelle loi sur l’investissement n°22-18. Elle a analysé la nature juridique de l’agence ainsi que les différentes missions qui lui sont confiées. L’étude a montré que le législateur algérien a renforcé le rôle de l’agence en la réorganisant, en élargissant ses prérogatives et en changeant sa dénomination de "l’Agence nationale de Développement de l’Investissement" à "l’Agence algérienne de Promotion de l’Investissement".** **Le législateur a également créé de nouvelles structures au sein de l’agence, telles que le guichet unique dédié aux grands projets et aux investissements étrangers, ainsi que la plateforme numérique de l’investisseur, dans le but de simplifier les procédures et de faciliter l’acte d’investir.** **Il ressort également que l’efficacité de l’agence dépendra de sa capacité à surmonter les défis liés à la bureaucratie et à instaurer la transparence dans la gestion des avantages et garanties offerts aux investisseurs, tout en renforçant son rôle d’accompagnateur réel de l’investissement à travers ses fonctions d’information et d’assistance technique.**

This academic study examines the legal status of the Algerian Investment Promotion Agency in light of the new Investment Law No. 22/18. The study analyzes the legal nature of the agency and the various tasks assigned to it. It reveals that the Algerian legislator has strengthened the agency's position by reorganizing it, expanding its powers, and changing its name from the “National Agency for Investment Development” to the “Algerian Investment Promotion Agency.” Furthermore, the legislator established new structures within the agency, including the One-Stop Shop for Major Projects and Foreign Investments, and the Digital Platform for Investors, with the aim of simplifying procedures and facilitating investment. The study also indicates that the agency's effectiveness depends on its ability to overcome bureaucratic challenges and establish transparency in managing the incentives and guarantees offered to investors, in addition to activating its role as a genuine facilitator of investment through its informational and technical functions.
