دور المحكمة الدستورية في الإنتخابات الرئاسية 2024

Abstract

تناولت هذه الدراسة دور المحكمة الدستورية باعتبارها الضامن الأعلى للشرعية الدستورية وخاصة في إعلان النتائج النهائية في الإنتخابات الرئاسية سنة 2024 في الجزائر من خلال تقديم مفهوم المحكمة الدستورية وإلى نشأتها بالإظافة إلى تشكيلتها من ناحية التركيبة وعدد الأعضاء وطريقة تعيينهم ومدة العضوية ثم نذهب إلى إختصاصاتها العامة و خاصة في المجال الإنتخابي من خلال مراقبة شروط الترشح والبث في الطعون إلى إعلان النتائج النهائية، حيث تؤدي المحكمة الدستورية دورا محوريا في التحقق من نزاهة الإنتخابات وشرعيتها وضمان إحترام القوانين مما يعزز ثقة المواطنين في المسار الديمقراطي.

This study addresses the role of the Constitutional Court as the supreme guarantor of constitutional legitimacy, particularly in announcing the final results of the 2024 presidential elections in Algeria. It introduces the concept of the Constitutional Court, its origins, its composition, the number of members, the method of their appointment, and the term of membership. It then examines its general powers, particularly in the electoral field, by monitoring the eligibility criteria, adjudicating appeals, and announcing the final results. The Constitutional Court plays a pivotal role in verifying the integrity and legitimacy of elections and ensuring respect for laws, which enhances citizens' confidence in the democratic process.

Cette étude examine le rôle de la Cour constitutionnelle en tant que garante suprême de la légitimité constitutionnelle, notamment dans la proclamation des résultats définitifs de l'élection présidentielle de 2024 en Algérie. Elle présente le concept de Cour constitutionnelle, ses origines et sa composition, notamment sa composition, son nombre de membres, son mode de nomination et la durée de son mandat. Elle examine ensuite ses pouvoirs généraux, notamment en matière électorale, en contrôlant les conditions d'éligibilité, en statuant sur les recours et en proclamant les résultats définitifs. La Cour constitutionnelle joue un rôle essentiel dans la vérification de l'intégrité et de la légitimité des élections et dans le respect des lois, renforçant ainsi la confiance des citoyens dans le processus démocratique. .
