Abstract: Due to the seriousness of the blood transfusion process and the potential harm it may cause to the donor or recipient, Algeria has established specific laws to regulate this process, Although there are no specific rules regarding liability for blood transfusions, general civil liability laws apply Therefore, insurance companies play an important role in protecting individuals from the risks associated with blood transfusions, as they ensure compensation for those affected, especially with the increasing number of blood donors in Algeria, It is essential to have preventive and deterrent protection in place; if harm occurs due to a blood transfusion, compensation can often be provided without the need to prove fault, This also serves to deter negligence and intentional harm related to this process, This means that doctors are obligated to ensure the safety of the blood transfusion process
