قاعدة إحياء الولد ودورها في توسيع حالات إثبات النسب Title of the article Child reviving rule and its role in expanding paternity cases

Abstract

يعد النسب من الموضوعات المهمة جدا في المنظومة التشريعية،وهذا لإرتباطه الوثيق بالأسرة ، لهذا فهو يعد أحد مقاصد الشريعة الخمسة التي جاءت لحفظها ، لذا جاءت نصوص القانون والشريعة متواطئة ومتوافقة تقريبا في تحديد إجراءات إثبات النسب وحصرها، وهذا إعمالا لمبدأ الإحتياط في النسب، ومع هذا فإن استقراء النصوص الشرعية والقانونية يدل بكل وضوح أن هناك قاعدة أخرى تم اللجوء إليها وتطبيقها في الكثير من القضايا الإجتهادية من أجل إثبات النسب، وهي قاعدة إحياء الولد، و إذا كان الأصل في النسب هو الإحتياط فيه ما أمكن، فإن النصوص والإجتهادات الفقهية لم تخل من إعمال قاعدة إحياء الولد، وهنا تطرح إشكالية المجالات التي تم تطبيق القاعدة بشأنها، وهل يمكن العمل بها حاليا لإثبات نسب الأطفال. Abstract: Filiation is one of the very important issues in the legislative system, This is due to its close association with the family, so it is one of the five objectives of Sharia that came to preserve it. Law and Sharia texts have been almost consistent and compatible in determining filiation proceedings and limiting them in implementation of the principle of precaution in lineage. so,extrapolating the texts of law and Sharia indicates clearly that there is another rule that has been resorted to and applied in many cases of jurisprudence in order to establish filiation, which is child reviving rule. If the principle is precaution in filiation as much as possible, then the provisions and jurisprudence are not without the implementation of the rule of child reviving, and here the problematic arises about the areas in which the rule has been applied, and the possibility of using it currently to prove the lineage of children
