Abstract: The nature of this research highlights the harm that may be inflicted on property rights holders and the burden on citizens and judicial authorities alike, due to the expiration of the deadlines for settling their properties or their being registered in the name of the state, as it has become necessary to reconsider the provisions of Article 23 bis of Order No. 75-74, including Instruction No. 4060 and Memorandum No. 910, as Article 166 of the Finance Law for the year 2025 was issued, amending and supplementing the provisions of the aforementioned Article 23 bis, which was followed by the issuance of Instruction No. 4300, which addressed the methods of settling properties in the account of unclaimed properties during land survey work and those registered in the name of the state by mistake, as it aims to take new measures in administrative settlement to enable citizens to benefit from settling their properties without resorting to the judiciary, as we used the analytical method, which is the most appropriate for analyzing texts, and we reached a set of results, including that this instruction addressed problems and obstacles that were burdening citizens and reducing recourse to the judiciary, especially in terms of the deadlines for filing and processing files
