Abstract: The constitution as most important foundations, establishing the rule of law, is the relationship regulator between the state and its constituent institutions , and individuals, this prompts us to discuss the problem of the constitution's contribution in building a state of law, Where its status in countries is linked to the extent of its enjoyment of Highness in form and subject, which embodied by effective oversight of laws's . The state of law is organized by implementing the powers principle separation and employing it in controlling institutions relationship and preserving the individual's right. The state of law is based on the rule of law's princple including rulers and ruled, which will make sense by backing it up by free and independent judiciary guarding sovereignty and oblige everyone to submit to it provisions, We conclude that the best reference which realize the state of law building process is constitutional legitimacy.
