مكافحة جرائم المنصات الرقمية في التشريع الجزائري

Abstract

تناولتهذه الدراسة مكافحة جرائم المنصات الرقمية في التشريع الجزائري في ظل الانفتاح الرقمي الذي نشهده اليوم، فالمنصات الرقمية اضحت ابرز مظاهر الثورة التكنولوجية والمعلوماتية اذ تطورت من مجرد ادوات للتواصل والترفيه الى فضاءات حيوية تكتسي مختلف جوانب حياتنا اليومية، ففي ظل الهيمنة الاقتصادية والسيطرة الاييولوجية، برزت المنصات الرقمية في الصدراة للمرتكزات التي قومت تعاملاتنا اليومية وسايرت نجاحاتنا، فاتخذتها الهيئات الكبرى عامة و الافراد خاصة كركيزتها المحورية في جميع شوؤن الحياة، وبالاندفاع التكنولوجي والسباق نحو الاستئثار العالمي الذي نشهده اليوم، انبثقت سلوكيات عدائية جعلت من البنى التحتية لهذه المعطيات الرقمية ملاذ لتنفيذها، و على اثر ذلك سلطنا الضوء على مفهوم المنصات الرقمية وبداية ظهورها ونشأتها، ثم عرضنا اهم مختلف أنماط المنصات الرائدة في العالم الافتراضي. وفي نفس الصدد أسسنا على النصوص القانونية التي اقرها المشرع الجزائري بعض الجرائم الالكترونية التي جعلت من المنصات الرقمية وسيلة لها لتنفيذها، وفي المقابل بعض الجرائم المرتكبة على المنصات الرقمية، متخذين من ذلك اركان الجرائم والجزاءات المقررة لها في ظل سعي المشرع الجزائري لمواكبة تحدي هدذه الجرائم من خلال تعديلاته الاخيرة لقانون العقوبات الجزائري.

This study examined the role played by digital platforms in various aspects of our daily life. Against the backdrop of economic hegemony and ideological control, digital platforms have emerged as the primary pillars that structured our daily interactions and accompanied our successes. Major institutions in general, and individuals in particular, have adopted them as their central cornerstone in all life affairs. Driven by technological momentum and the race toward global monopolization that we witness today, hostile behaviors have surfaced, turning the infrastructure of these digital assets into a haven for their execution. Consequently, we have shed light on the concept of digital platforms, their origins and emergence, and then presented the most significant types of leading platforms in the virtual world. In the same context, we have grounded our analysis in the legal provisions by which the legislator has criminalized certain cyber offenses – those that use digital platforms as a means of execution – and, conversely, certain offenses committed on digital platforms. In doing so, we have drawn upon the constitutive elements of these offenses and the prescribed sanctions, within the framework of the Algerian legislator's efforts to meet the challenge posed by these offenses through his recent amendments to the Algerian Penal Code.
