Abstract: The article discusses the right of withdrawal as a protective solution introduced by the legislator in the latest amendment to the Consumer Protection Law, Law No. 09-03, as amended and supplemented by Law No. 18-09. Although the law referred its implementation to provisions that were to be issued in the future, these have not yet materialized. The article thus comes as a theoretical approach highlighting that the idea of withdrawal is already familiar and well-established in general legal rules. In essence, it is close to the right of withdrawal enshrined in the Consumer Protection Law and recognized in comparative legislation. However, the fact that both systems share the same core does not mean that they share the same considerations and foundations. This distinction is precisely what the study sought to clarify
