نجاعة الإستثمار وتحديات الذكاء الإصطناعي في الجزائر

Abstract

تتناول هذه الدراسة إشكالية توظيف الذكاء الاصطناعي في منظومة الاستثمار في الجزائر، مستعرضةً الطبيعة القانونية للأنظمة الذكية وآليات توظيفها في رقمنة الصفقات والخدمات الإدارية وتعزيز مناخ الأعمال، وتكشف الدراسة عن تناقض منهجي يتمثل في السبق التقني على حساب الأطر التشريعية الضابطة، مما يُفرز فراغاً إجرائياً يمسّ حقوق المستثمر في مواجهة القرار الخوارزمي. وتنتهي الدراسة باقتراح جملة من التوصيات التشريعية لسد هذه الفجوة وضمان بيئة استثمارية رقمية آمنة وعادلة.

This study examines the use of artificial intelligence within Algeria's investment framework It analyzes the legal nature of intelligent systems and their role in digitizing administrative services and improving the business climate the study reveals a systemic contradiction: technological advancement outpacing its legislative framework, creating a procedural vacuum that jeopardizes investors' rights against algorithmic decisions the study concludes with legislative recommendations to bridge this gap and ensure a secure and fair digital investment environment.

Cette étude examine l'utilisation de l'intelligence artificielle dams le système d'investissement algérien elle analyse la nature juridique des systèmes intelligents et leurs mécanismes dams la numérisation des transactions administratives et l'amélioration du climat des affaires l'étude révèle une contradiction méthodologique entre l'avancée technologique et le retard législatif, créant un vide procédural qui nuit aux droits de l'investisseur face à la décision algorithmique. Elle se conclut par des recommandations législatives visant à combler ces lacunes.
