عقد الوقف العام على ضوء القانون رقم 25-06

Abstract

نخلص في هذه الدراسة أن قانون الأوقاف الجديد 25-06 قد نظم عقد الوقف العام كونه عقدا وإرادة منفردة في نفس الوقت حيث ينطبق عليه شروط العقد في القانون المدني فيما لم يرد بها نص، كما تبين أنه يتم تكوين عقد الوقف إما بإنشاء عقد ويكون بتوافر اركانه الجوهرية المتمثلة في الصيغة والواقف والموقوف عليهم ومحل الوقف مع وجوب صحة كل ركن وتوافر شروط نفاذه، كما يمكن أن ينشأ عن طريق ما يعرف بالاسترجاع حيث يشكل الألية الرئيسية التي اعتمدها المشرع لإعادة الاعتبار للأملاك الوقفية التي فقدت طابعها الوقفي بفعل الظروف التاريخية ،وبمجرد تكوينه بشكل صحيح او استرجاعه ينشأ له الشخصية المعنوية و الذمة المالية المستقلة كما يترتب عليه حقوق تكمن في استحقاق المنافع واحترام شرط الواقف والتزامات فتنحصر في التمثيل القانوني للوقف ،كما يطرأ على الوقف ما يعرف بالاستبدال والانتهاء في حالات حددها المشرع .

Dans cette étude, nous concluons que la nouvelle loi sur le Waqf 25-06 a réglementé le contrat de Waqf public en tant que contrat et volonté unilatérale en même temps, car les conditions du contrat du droit civil s'appliquent à celui-ci dans la mesure où il n'y a pas de texte. Il s'avère également que le contrat de Waqf est formé soit par la création d'un contrat, ce qui se fait en remplissant ses éléments essentiels, à savoir la formule, le Waqif, les bénéficiaires et l'objet du Waqf, avec l'obligation de la validité de chaque élément et la disponibilité des conditions de sa validité, soit par ce que l'on appelle la récupération, qui constitue le principal mécanisme adopté par le législateur pour restaurer les biens Waqf qui ont perdu leur caractère de Waqf en raison des contextes historiques. Une fois qu'il est correctement constitué ou récupéré, il acquiert une personnalité morale et une responsabilité financière indépendante, ce qui entraîne des droits qui résident dans le droit aux avantages et le respect de la condition du Waqif, et des obligations qui se limitent à la représentation légale du Waqf. Le Waqf subit également ce que L’on appelle le remplacement et la fin dans les cas spécifiés par le législateur. This study concludes that the new Waqf Law 06-25 regulates the public waqf contract as both a contract and a unilateral act of will. The conditions for contracts in the Civil Code apply to it where not otherwise stipulated. It also shows that a waqf contract is formed either by establishing a contract, which requires the presence of its essential éléments: The offer and acceptance, the endower,the bénéficiaires,and the subject matter of the waqf , with each element being valid and its conditions for enforcement met ; or it can be established through what is known as restitution, which constitutes the main mechanism adopted by the legislator to restore the status of waqf properties that have lost their waqf character due to historical circumstances.Once correctly established or restitutiond , it acquires a legal personality and an Independent financial liability . It also entails rights, namely the entitlement to benefits and respect for the endower's conditions, and obligations, which are limited to the legal représentation of the waqf. Furthermore, a waqf can be subject to substitution and termination in cases specified by the legislator.
