وقف براءة الإختراع في التشريع الجزائري

Abstract

يُعالج هذا البحث وقف براءة الاختراع في التشريع الجزائري كصورة حديثة لتطور نظام الوقف، خاصة في ظلصدورالقانون الأوقاف رقم 25-06 الذي أقر بإمكانية الوقف المؤقت. وتبرز أهمية الموضوع في اعتبار براءة الاختراع مالاً منقولاً معنوياً ذا طبيعة مؤقتة قابلا للاستغلال،حيث يسمح بتخصيص عائده المالي لأغراض البر والخير. وعليه تعتمد الدراسة على المزاوجة بين قانون الأوقاف والأمر المتعلق ببراءة اختراع، ذلك لبيان الشروط الموضوعية والشكلية، خاصة الرسمية والتسجيل ذلك لضمان النفاذ هذا التصرف. إضافة الى الآثار القانونية المتمثلة في زوال ملكية الواقف وانتقال المنفعة، مع انسجام الوقف المؤقت مع الطبيعة الزمنية للبراءة.

This study examines the endowment of patent rights in Algerian law as a modern form of waqf, particularly following Law No. 25-06, which introduced temporary endowment. The importance lies in the patent as a temporary right with economic value, allowing its revenues to be allocated for charitable or public benefit purposes. The research combines the rules of waqf law and industrial property law by analyzing substantive and formal conditions, especially registration and enforceability, as well as the legal effects resulting from such endowment.

Cette étude traite du waqf du brevet d’invention en droit algérien comme une forme moderne d’endowment, notamment à la lumière de la loi n° 25-06 ayant introduit le waqf temporaire. L’intérêt réside dans le fait que le brevet constitue un droit temporaire à valeur économique, permettant d’affecter ses revenus à des fins caritatives ou d’utilité publique. L’analyse repose sur la combinaison entre le droit des waqfs et celui de la propriété industrielle, en examinant les conditions de fond et de forme, notamment l’enregistrement et l’opposabilité, ainsi que les Effets juridiques en découlant.
