المسؤولية الإدارية عن الأخطاء الطبية

Abstract

شغلت المسؤولية الإدارية حيزا واسعا في ميدان الصحة، وذلك من خلال اشتراط ركن الخطأ الطبي وتوفر شروط أخرى كأساس لقيام المسؤولية في المرفق الطبي، وكذلك التعويض الذي يكون معتمدا على الضرر المرتكب، لأنه لا بد من وقوع علاقة مباشرة بين الضرر والخطأ. ويبقى القاضي الإداري هو المختص في تقدير جسامة الخطأ الطبي، فللمريض الحق في اللجوء إلى القضاء للمطالبة بالتعويض عن الضرر الذي أصابه جراء المرفق الاستشفائي.
