حرية التعبير والبحث العلمي في التشريع الجزائري

Abstract

تتناول هذه المذكرة حرية التعبير والبحث العلمي في التشريع الجزائري. ومن خلال المنهج التحليلي النقدي، يبرز البحث فجوة تطبيقية بين النصوص الضامنة والواقع الميداني، تُعزى لغموض بعض المفاهيم القانونية، وقصور التمويل، وهجرة الكفاءات، وتحديات النزاهة الأكاديمية. وتخلص الدراسة إلى ضرورة دقة الصياغة التشريعية، ورفع الميزانية المخصصة للبحث، وتعزيز استقلالية المؤسسات العلمية، وربط المخرجات بالتنمية المستدامة، لضمان ممارسة حرة ومسؤولة تتوافق مع المعايير الدولية.

This thesis addresses freedom of expression and scientific research in Algerian legislation. Utilizing a critical analytical approach, the research highlights an implementation gap between legal guarantees and reality on the field, which is attributed to the ambiguity of certain legal concepts, funding shortages, brain drain, and academic integrity challenges. The study concludes with the necessity of precise legislative drafting, increasing the budget allocated for research, enhancing the autonomy of scientific institutions, and linking research outcomes to sustainable development, in order to guarantee a free and responsible practice in line with international standards.

Ce mémoire traite de la liberté d'expression et de la recherche scientifique dans la législation algérienne. À travers une approche analytique et critique, la recherche met en évidence un fossé d'application entre les textes de garantie et la réalité sur le terrain, attribué à l'ambiguïté de certains concepts juridiques, au déficit de financement, à la fuite des cerveaux et aux défis de l'intégrité académique.
