التحري بالوسائل الالكترونية الحديثة

Abstract

سعى المشرع الجزائري إلى تكريس آليات حديثة للتحري الإلكتروني من خلال إدراج وسائل تقنية تسمح بتتبع الجرائم الإلكترونية وكشف مرتكبيها، مع الحرص على تحقيق التوازن بين فعالية التحري وحماية الحقوق والحريات الأساسية للأفراد. وقد تجسد ذلك من خلال التعديلات الواردة على قانون الإجراءات الجزائية،لاسيما بموجب الأمر 15-02 المؤرخ في 23 جويلية 2015، الذي أقر مجموعة من الإجراءات المتعلقة بالمراقبة الإلكترونية واعتراض المراسلات والتفتيش والحجز الإلكتروني. كما تناولت الدراسة مختلف وسائل التحري الإلكتروني المعتمدة قانوناً،والصعوبات التقنية والبشرية التي تعيق فعاليتها،إضافة إلى الإشكالات المرتبطة بحجية الدليل الإلكتروني وطرق إثباتها أمام القضاء. وخلصت الدراسة إلى أن فعالية التحري الإلكتروني تبقى مرتبطة بمدى تطوير التشريعات الوطنية، وتوفير الكفاءات التقنية المتخصصة، وتعزيز الضمانات القانونية الكفيلة بحماية الحياة الخاصة وحرية الأفراد أثناء مباشرة إجراءات البحث والتحري.

Le législateur algérien a cherché à consacrer des mécanismes moderns d'enquête électronique en introduisant des moyens techniques permettant de traquer les cyber crimes et d'en identifier les auteurs, tout enveillant à l'équilibre entre l'efficacité de l'enquête et la protection des droits et libertés fondamentaux des individus. Cela s'estconcrétisé par les amendements apportés au Code de procedure pénale, notamment par l'ordre n° 15-02 du 23 juillet 2015, qui a instauré un ensemble de mesures relatives à la surveillance électronique, l'interception des correspondances, ainsiqu'à la perquisition et la saisie électronique. L'étude a également abordé les different moyens d'enquête électronique légale mentagréés, ainsique les difficultés techniques et humaines qui entravent leur efficacité, outre les problématiques liées à la force probante de la prevue électronique et ses modes de prevue devant la justice. L'étude a conclu quel'efficacité de l'enquête électronique reste tributaire du développement de la legislation nationale, de la mise à disposition de compétences techniques spécialisées, et du renforcement des garantiesjuridiquespropres à protéger la vie privée et la liberté des individuslors des procédures de recherche et d'enquête.

The Algerian legislator has sought to establish modern electronic investigation mechanisms by introducing technical means that allow for the tracking of cybercrimes and the identification of their perpetrators, while ensuring a balance between the effectiveness of the investigation and the protection of individuals' fundamental rights and freedoms. This has been embodied through the amendments made to the Code of Criminal Procedure, particularly under Ordinance No. 15-02 dated July 23, 2015, which established a set of procedures related to electronic surveillance, interception of correspondence, and electronic search and seizure. The study also examined the various legally adopted electronic investigation methods, the technical and human difficulties hindering their effectiveness, and the issues related to the legal weight of electronic evidence and its methods of proof before the courts. The study concluded that the effectiveness of electronic investigation remains linked to the development of national legislation, the availability of specialized technical expertise, and the strengthening of legal guarantees to protect the privacy and freedom of individuals during search and investigation procedures.
