تشجيع الاستثمار في قطاع المناجم وفقا للقانون25-12

Abstract

جاءت هذه الدراسة لتسليط الضوء على قانون الاستثمار المنجمي الجديد و دوره في استقطاب المستثمرين و رؤوس الاموال، من خلال ما جاء به من مزايا و حوافز . و قد هدفت الى توضيح الاطار المؤسساتي للقانون ، عن طريق تحديد الدورالذي تقوم به الوكالة الوطنية للنشاطات المنجمية ، و وكالة المصلحة الجيولوجية من اجل تسهيل الإجراءات الادارية،و الحصول على البيانات التي يحتاجها المستثمر. كما تناولت الدراسة الضمانات المالية التي يمنحها القانون 25-12 للمستثمرين ، و كيفية الاستفادة منها و الضمانات القضائية ، على غرار اللجوء الى التحكيم ، إضافة الى الاحكام و التصرفات القانونية المرتبطة بالنشاط المنجمي.

Cette étude vise à mettre en lumière la nouvelle loi sur l'investissement minier et son rôle dans l'attraction des investisseurs et des capitaux, à travers les avantages et les incitations qu'elle octroie. Elle s'attache à clarifier le cadre institutionnel de cette loi en identifiant le rôle joué par l'Agence Nationale des Activités Minières et l'Office National de la Recherche Géologique dans la facilitation des procédures administratives et la fourniture des données requises par les investisseurs.Par ailleurs. L’étude examine les garanties financières accordées aux investisseurs en vertu de la loi 25-12, les mécanismes d'octroi de ces avantages, ainsi que les voies de recours et garanties judiciaires disponibles, y compris le recours à l'arbitrage. Enfin, elle traite des dispositions légales et des transactions relatives aux activités minières.

This study aims to highlight the new Mining Investment Law and its role in attracting investors and capital through the advantages and incentives it provides. It seeks to clarify the institutional framework of the law by identifying the role played by the National Agency for Mining Activities and the Geological Survey Agency in facilitating administrative procedures and providing the data required by investors. The study also examines the financial guarantees granted to investors under Law 25-12, the mechanisms for benefiting from these guarantees, and the judicial safeguards available, including recourse to arbitration. In addition, it addresses the legal provisions and transactions related to mining activities.
