المفاهيم الحديثة للإرهاب في القانون الدولي

Abstract

يحتل الإرهاب مركز الصدارة من بين القضايا العالمية المعاصرة بامتياز، فبالرغم من محاولات المجتمع الدولي إعطاء تعريف له بقي هذا المصطلح غامضا حيث تعرض للتلاعبات السياسية نظر لتضارب المصالح ، وبقيت الجهود الدولية قاصرة عن إعطاء مفهوم واضح له واقتصارها على مجرد التوصيف لبعض الأفعال عدت جرائم إرهابية في اتفاقيات جاءت في إطار مناسبات تعبر عن بعض أشكال الإرهاب، ونتيجة لذلك عمدت بعض الدول لتوظيفه خدمة لمصالحها وربطه ببعض الأفعال المشروعة، لتتجه الأنظار نحو مكافحته بدل تعريفه في مقابل ذلك تعرضت بعض المفاهيم المشابهة له للخلط المتعمد بينها وبين الإرهاب. Le terrorisme occupe une place importante dans la scène mondiale, ce phénomène mondial reste identifiable malgré les efforts de la communauté internationale pour le définir, la définition de terrorisme est en relation étroite avec les enjeux et les intérêt de chaque pays, les définitions actuelles de terrorisme ne sont que des descriptions de quelques formes de violence ceci a pousse les grand pays à utiliser le terrorisme pour servir ses intérêts devant une telle situation, la lutte de terrorisme s'est mêlé à la définition de terrorisme. The issue of international terrorism is among the most significant contemporary and world matters, and even though, the international community has attempted to give it a clear definition yet, the term of terrorism still remains ambiguous, and has been subject to political manipulation because of conflicting interests, in addition to this, the international efforts are still unable to give it any clear definition as it simply described deeds or actions, which are considered terrorist crimes according to agreements, which came in particular circumstances to tackle about some terrorist forms, and came to make use of it so as to serve their interests and link it with some legal deeds and therefore efforts have been combined to fight the said terrorism, instead of attempting to give it some clear definition, whereas, some concepts have been deliberately subjected to misemploying and made them confused with terrorism.
