مبادئ سير المرفق العمومي بين الاستمرارية والتحول

Abstract

الملخص البحث تناول بالدراسة والتحليل مبادئ المرفق العمومي بين الاستمرارية والتحول من خلال استقراء مبادئ المرفق العام في مفهومها الكلاسيكي؛ وهي مبدأ الاستمرارية ومبدأ المساواة ومبدأ التكيف من خلال دراسة مضمونها وأساسها القانوني وضمانات تجسيدها وكذا الاستثناءات الواردة عليه او خصائصها، ثم التحولات التي مستها، لجعلها تتلاءم مع الظروف الطارئة والتحولات الاجتماعية، وكذا تلك الناتجة عن التطورات الحاصلة في مهام المرفق العام وطرق تسييره من خلال ولوجه عالم الرقمنة بسبب التحديات التكنولوجية، الأمر الذي أدى إلى ظهور مبادئ جديدة أصبحت تحتل مكانة في المرفق العام بجانب المبادئ التقليدية، بشكل انعكس على العلاقة بين المرفق والمرتفقين بتقريب الإدارة من المواطن وتبسيط إجراءات استيفاء الخدمة بكل شفافية ووضوح والولوج إلى المرافق العامة بيسر، سعيا لكسب رضا المرتفق على أداء المرفق.

Résumé La recherche a porté sur l’étude et l’analyse des principes du service public entre continuité et transformation, en extrapolant les principes classique du service public; Le principe de continuité et le principe d'égalité et le principe d'adaptation, en étudiant leur contenu, base juridique, les garanties de leur concrétisation, ainsi que leurs exceptions puis leurs caractéristiques. Puis il a traité des transformations qu’il a abordées pour les adapter aux conditions d'urgence et aux transformation sociales, ainsi que celles résultant de l’évolution des missions de service public et des modes de gestion de celui-ci à travers de la numérisation due aux mutations technologiques. Ce qui a conduit à l'émergence de nouveaux principes qui ont occupé une place dans l'équipement public à côtés des principes traditionnels. D’une manière qui se reflète sur la relation entre le service et l’usager en rapprochant l’administration du citoyen et en simplifiant les procédures pour remplir le service en toute transparence et clarté et en permettant un accès facile aux services publics, dans un effort pour gagner sur la performance de services

Summary : The research focused on the study and analysis of the principles of public service between continuity and transformation, extrapolating the classic principles of public service; The principle of continuity and the principle of equality and the principle of adaptation, by studying their content, legal basis, the guarantees of their concretization, as well as their exceptions and then their characteristics. He then dealt with the transformations he has approached in order to adapt them to emergency conditions and social transformations as well as those resulting from the evolution of public service missions and the modes of management thereot through digitization due to technological changes. This has led to the emergence of new principles which have occupied a place in public facilities alongside traditional principle . In a way that reflects on the relationship between the service and the user by bringing the administration closer to the citizen and by simplifying the procedures for fulfilling the service with complete transparency and clarity and allowing easy access to public services, in a effort to gain on the performance of public services.
