الحماية الدولية للعمال المهاجرين

Abstract

الملخص العام: تناولنا في هذه الدراسة موضوع الحماية الدولية والإقليمية للعمال المهاجرين وافراد اسرهم، وهذا لما تتعرض له هذه الفئة من انتهاكات، ومن خلال الاتفاقيات والتوصيات التي تم تحضيرها من طرف منظمة العمل الدولية والتي نصت علىاحكام خاصة لحماية العمال المهاجرين بالإضافة الى عديد الأنظمة الإقليمية أبرزها: الأوروبية والافريقية والأمريكية وكذا الدور المهم التي تعرضه كل من منظمة العمل العربية ومنظمة الدولية للهجرة، مع حرص على دعوة الدول التي لم تصادق على اتفاقيات الدولية والمنطوي دورها في الحفاظ على حقوق العمال المهاجرين وافراد اسرهم، مع خلق آليات تشكل انسجام بينها و بين مختلف التشريعات الوطنية و الدولية التي تصب في صالح حماية هذه الفئة.

Résumé général : Cette étude porte sur la protection internationale et régionale des travailleurs migrants et des membres de leur famille. Cela est dû à des violations de cette catégorie, et par des conventions et des recommandations préparées par l’Organisation internationale du travail (OIT), qui stipulent des dispositions spéciales pour la protection des travailleurs migrants en plus de plusieurs règlements régionaux. l’Europe, l’Afrique et les États-Unis, ainsi que le rôle important que jouent l’Organisation arabe du travail (OIT) et l’Organisation internationale pour les migrations (OIM) d’offrir, tout en appelant les Etats qui n’ont pas ratifié les conventions internationales et dont le rôle est de sauvegarder les droits des travailleurs migrants et de leurs familles, créer des mécanismes qui constituent une harmonie entre eux et les différentes législations nationales et internationales dans le but de protéger ce groupe.

General Summary: This study deals with the international and regional protection of migrant workers and members of their families. This is due to violations of this category, and through conventions and recommendations prepared by the International Labour Organization (ILO), which stipulate special provisions for the protection of migrant workers in addition to several regional regulations. Europe, Africa and the United States, as well as the important role that the Arab Labour Organization (ILO) and the International Organization for Migration (IOM) offer, while calling on States that have not ratified international conventions and whose role is to safeguard the rights of migrant workers and their families, to create mechanisms that constitute harmony between them and the various national and international legislation in the interest of protecting this group.
