Abstract

ملخص: من المؤكد أن طرق إبرام صفقات المؤسسات العمومية الاقتصادية، يجب أن يتم وفق المبادئ العامة التي أقرها المشرع الجزائري في المرسوم الرئاسي 15/247، إذ يمثل المرجع الإجرائي في مراحل الإبرام المختلفة، والمكرس لتلك المبادئ التي تشمل المساواة في الشفافية، والحرية في الوصول للطلبات، والسوناطراك باعتبارها شركة تهدف إلى تحقيق الربح و تسيير مرفق اقتصادي حيوي، قامت من خلال أجهزتها بتبني تعليمة داخلية مستوحاة من المرسوم المذكور آنفا، ملتزمة باحترام المبادئ العامة، مع بعض الخصوصيات والتي تتعلق بالنشر والاعلان و منح الأولوية للمنتوج الوطني.

Résumé: Les méthodes de conclusion des passations de marché par les entreprises économiques publiques, doivent être conformes aux principes généraux approuvés par le décret présidentiel numéro 15/247, qui représente la référence procédurale dans les différentes étapes de conclusion, la SONATRACH en tant qu’entreprise qui vise à réaliser des bénéfices et à exploiter une installation économique vitale avait adopté une instruction en interne inspirée du décret susmentionné, et s’est engagée à respecter ces principes généraux, avec, bien sur certaines spécificités liées à l’édition, la publicité et la priorisation du produit national.

Abstract: The methods of conclusion of procurement by public economic company must be in accordance with the general principles approved by Presidential Decree 15/247, which represents the procedural reference in the various stages of conclusion, SONATRACH, as a company which aims to make a profit and operate a vital economic facility, had adopted an internal instruction inspired by the aforementioned decree, and undertook to respect these general principles, with, of course, certain specificities related to publishing, advertising and prioritisation of the national product.
