Abstract

تهدف هذه الورقة البحثية إلى التطرق لمعالجة النشأة التاريخية والقانونية لنظام الصحة والسلامة المهنية على المستوى الدولي وما تجسد من قوانين وبروتوكولات وإجراءات حسب كل فترة من فترات الدراسة، بالإضافة إلى القوانين والمراسيم الـمُشّرعة من طرف الحكومة الجزائرية منذ الاستقلال إلى يومنا هذا، وأظهرت نتائج الدراسة أن العقود الأولى من التاريخ تميزت بالبساطة وانعدام قوانين وإجراءات محددة وصارمة في هذا المجال، وشيئا فشيئا تطور هذا المفهوم لدى أصحاب العمل وصاحبه ارتفاعا في تكلفته مع التطور التكنولوجي حسب كل فترة من فترات الدراسة إلى ما تجسد مؤخرا فيما يعرف بالمواصفة الدولية ISO 45001، بالإضافة إلى اسهامات الشريعة الإسلامية في هذا المجال وهو ما تجسد من خلال آيات قرآنية وأحاديث نبوية تحثُ على الحفاظ على النفس وما دونها. This research paper aims to address the historical and legal development of the occupational health and safety system at the international level, including the laws, protocols, and procedures that have been established during different periods of study. It also examines the laws and decrees enacted by the Algerian government since independence to the present day. According to the study's findings, history's early periods were defined by simplicity and a lack of precise and severe regulations and processes. This idea developed over time for employers, and as technology advanced, so did its cost, as evidenced in the recent International Standard ISO 45001. Additionally, contributions from Islamic law in this field are reflected in Quranic verses and prophetic traditions that emphasize the preservation of life and beyond.
