Abstract

لمؤسسة العمومية ذات الطابع الصناعي والتجاري شخص معنوي عام يخضع لقواعد قانونية ذات طبيعة مختلطة بين قواعد القانون العام والقانون الخاص تعتبر وسيلة لتدخل الدولة في النشاط الاقتصادي بشكل مباشر وطريقة لاستثمار الأموال العمومية مما يجعلها أداة للمساهمة في التنمية الاقتصادية الوطنية يحقق هذا النوع من المؤسسات هدفا مزدوجا فهي من. جهة تحقق عنصر الفاعلة كمهمة منوطة بالدولة أو أحد المؤسسات التابعه لها يتمثل ذالك في توفير خدمة عمومية بشكل مستمر و داءم و من جهة ثانية تسعى المردودية وهي بذالك تعتبر خاصية فريدة من نوعها على أساس أن هذا الصنف من المؤسسات يحقق المردودية كهدف اقتصادي حسب مقتضيات المنافسة بالإضافة إلى العادات المالية للخزينة هذا بالإضافة كونها وسيلة لتنفيذ السياسة الاقتصادية للدولة في آن واحدThis study falls within the provisions of public establishments within the framework of public economic law, so that it aims to search for the system of public establishments of an industrial and commercial nature and their role in the development of the national economy, by trying to adapt the rules applicable to these establishments between the rules of public law and private law on the one hand, and on the other hand to highlight the economic aspect of these establishments through their contribution to national development, whether directly or indirectly, With a few recorded observations. Through this, the various provisions related to the subject in Algerian legislation and doctrine were studied using the descriptive approach with the analytical sometimes, and the researcher reached some results ; the most important of which is that these establishments are independent legal persons subject to a hybrid juridical system between the rules of public law and private law, and are considered a strategic means to implement the economic policy of the state through its dual objective; to provide public service and achieve profitability according to the requirements of commercial competition.
