Preventive measures against corruption in the public sector التدابير الوقائية من الفساد في القطاع العام

Abstract

ان الفساد ظاهرة عالمية تعاني منها معظم الدول المتقدمة والمتأخرة ولكن بنسب متفاوتة من دولة إلى أخرى، ونظرا لخطورته وانتشاره الرهيب بسرعة وحرصا منه لمكافحته، اعتمد المشرع الجزائري بموجب القانون 06-01 مجموعة من التدابير للحد والوقاية من مشكلة الفساد في القطاعات العامة بهدف تعزيز النزاهة والمسؤولية والشفافية في تسيير هذا القطاع الهام وحماية المال العام من جرائم الفساد . أن المشرع الجزائري من خلال مصادقته على اتفاقية الأمم المتحدة والمتعلقة بمكافحة الفساد والوقاية منه قد اخذ منهج السياسة الجنائية الحديثة التي تعتمد على الوقاية من الجريمة قبل حدوثها وذالك من خلال وضع مبادئ وقائية للحد من وقوعها. Summary: Corruption is a global phenomenon that most advanced and developing countries suffer from, but in varying proportions from one country to another .Given its seriousness and terrible rapid spread, and out of its desire to combat it, the Algerian legislator adopted, under Law 06-01, a set of measures to limit and prevent the phenomenon of corruption in the public sector with the aim of enhancing integrity and responsibility.Transparency in the management of this important sector and protecting public funds from corruption crimes. We have concluded that the legislator, through its ratification of the United Nations Convention against and Prevention of Corruption, has followed the path of modern criminal policy that relies on preventing crime before it occurs by establishing preventive principles to limit its occurrence.
