Abstract

إن الإقرار بمجموعة من السلطات للدول الساحلية لمكافحة جريمة الصيد غير القانوني يعتبر ضروريا لتمكينها من الاستجابة لتهديدات الأمن البحري التي تمس مصالحها البحرية، وقد تبدو هذه النقطة بسيطة لأن القانون الدولي قد منح الدول سلطة اعتماد التشريعات واللوائح، فضلاً عن سلطة الإنفاذ التي تخولها صلاحية تنفيذ تلك القوانين، ولكن تعتبر تلك القوانين معقدة لأن الحقوق المعترف بها للدول والتزاماتها تختلف بحسب المناطق البحرية، مما يجعلها تعمل على تحقيق توزيع مناسب لسلطاتها في كل منطقة لتحسين الأمن البحري الذي يهدده الصيد غير القانوني، ولكن توجد عدة عوامل قانونية وغير قانونية تساهم في تطويره واستمراره مما تشكل عقبات أمام الدول في التعامل مع أنشطة إنفاذ القانون لتعزيز الأمن البحري مما يجعل الصيد غير القانوني مشكلة معقدة تتحدى جميع الدول والمنظمات المعنية بالإدارة المستدامة لمصايد الأسماك البحرية. Abstract: The recognition of a Collection of authorities for coastal states to combat the illegal fishing crime is necessary to enable them to respond to threats to maritime security that affect their maritime interests, and this point may seem simple because international law has given states the power to adopt legislation and regulations, as well as the enforcement authority that gives them the power to implement those Laws, however, are complex laws because the recognized rights and obligations of states differ according to marine areas, which makes them work to achieve an appropriate distribution of their powers in each region to improve maritime security that is threatened by illegal fishing. However, there are several legal and illegal factors that contribute to its development and continuation, which constitute obstacles for states in dealing with law enforcement activities to enhance maritime security, which makes illegal fishing a complex problem that challenges all states and organizations concerned with the sustainable management of marine fisheries.
