تدابيـــر الجــماعـــات المحليـــة في حمايـــة البيئـــة

Abstract

لقد تطرقنا في هذه الدراسة إلى الحقل العام لموضوع المحافظة على البيئة باعتبارها الوسط الذي يعيش فيه الإنسان ويمارس فيه نشاطه، فكانت لنا جولة مع مختلف التشريعات الدولية والوطنية التي اهتمت بحماية البيئة وعالجنا بالأساس الدور الذي تقوم به الجماعات المحلية في هذا المجال وذلك من خلال الاختصاصات والصلاحيات الممنوحة لها في ظل قانون البلدية والولاية وكذلك من خلال القوانين الأخرى ذات الصلة بالبيئة لاسيما القانون 03-10المتعلق بحماية البيئة في ظل التنمية المستدامة، حيث اشتملت على عدة ميادين كالصحة وقطاع الغابات وكذا تسيير النفايات، كما تستخدم البلدية والولاية في ذلك وسائل و الآليات تسمح باتخاذ تدابير ذات طابع وقائي سابقة لوقوع الضرر تجسدت في المخططات البيئية لتوجيه التنمية المحلية وكذا الضبط الإداري، وخلصنا إلى ضرورة تعزيز الجماعات المحلية بالوسائل المادية والبشرية اللازمة للقيام بهذه المسؤولية.

in this study ,we have addressed the general field ofenvironmental conservation as the environment in which people live and practice their activities, where we have had various international and national legislations’ that focused on the environmental, and we have mainlyaddressed the role played by local communities in this area through the competencies and power,conferred upon them under municipal and state laws as well as through other laws relevant to the environment, particularly law 03-10 regarding the protection of the environmentunder the context of sustainable development, in which it has includes several fields, such as health, the forest sector, and waste management, the municipality and the stats also use means and mechanisms that allow for measures of a pre-harm preventive nature, embodied in environmental plans schemes to guide local development as well as administrative control, we have concluded that communities should be strengthenedby the necessarymaterial and human means; to fulfill this responsibility.

La conservation de l'environnement, au tant qu'il s'agit le milieu ou vivait et exerçait ses activités. Nous avons parcouru diverses législations internationales et nationales soucieuses de protéger l'environnement, et nous avons traité principalement du rôle joué par les groupes locaux dans ce domaine à travers les spécialisations et les pouvoirs qui leur sont accordés par les lois communales et étatiques, ainsi que par les autres lois liées à l'environnement, notamment la loi 03-10. La protection de l'environnement dans la perspective du développement durable, qui englobe plusieurs domaines tels que la santé, le secteur forestier ainsi que la gestion des déchets. La municipalité et l'État utilisent également des moyens et des mécanismes qui permettent de prendre des mesures à caractère préventif avant la survenance de dommages ont été incarnées dans des plans environnementaux pour guider le développement local ainsi que dans le contrôle administratif. Nous avons conclu à la nécessité de renforcer les communautés locales avec les moyens matériels et humains nécessaires pour assumer cette responsabilité.
