Abstract

للتوثيق الالكتروني أهمية كبيرة في المجال الالكتروني وتكنلوجيا المعلومات، إذ يعمل على خلق بيئة الكترونية آمنة للتعامل عبر الانترنت. إن توفير الثقة والأمان لدى المتعاملين يأتيان في مقدمة الضمانات التي يتعين توافرها لازدهار التعاملات الإلكترونية، وهو ما يتطلب استحداث أجهزة محايدة تسمى جهات التوثيق الإلكتروني تقوم بدور الوسيط المؤتمن بين المتعاقدين، فتؤكد هويتهم وتحدد أهليتهم في التعامل، كما تضمن سلامة محتوى البيانات المتداولة عبر الشبكة، وتصدر شهادات الكترونية. وأمام الدور المهم لجهة التوثيق الإلكتروني قامت التشريعات المختلفة بما فيها التشريع الجزائري بتنظيم أحكاما ضمن قانون 15-04 المحدد للقواعد العامة للتوقيع والتصديق الإلكترونيين Abstract: Electronic authentication is of great importance in the field of electronic and information technology as it creates a secure electronic environment for dealing online. The provision of confidence and security to the customers are among the first guarantees to be available for the growth of electronic transactions, which requires the development of neutral devices called electronic authentication bodies acting as a trusted intermediary between contractors to confirm their identity and determine their eligibility in dealing, it also ensures the integrity of the content of data transmitted over the network, and issues electronic certificates. In light of the important role of electronic documentation, various legislations, including Algerian legislation, have regulated provisions under Law 15-04, which is set out in the general rules of electronic signature and certification.
