Abstract: This study focuses on clarifying the role played by the competent judicial authorities in upholding the principle of the rule of law when considering disputes arising from construction and development works. When damage results from or in connection with such works, the injured party has the right to resort to the ordinary or administrative courts to assert their rights or obtain fair compensation. From this perspective, this paper aims to highlight the limits of the jurisdiction of both the administrative and ordinary courts when dealing with construction and reconstruction disputes, and to explain how they contribute to achieving justice and protecting rights within the framework of the rule of law
